An excellent and well thought out presentation of issues. Would love to see a healthy dialogue regarding some of the positions put forth.

I will start with this one:
"Unfortunately, many courts appear to evince unwarranted deference to police decisions, no matter how unsupported they are by objective indications of danger." (pg 96-97)

Why does this occur and how is it best handled? Do we the public place to much reliance upon the police to behave in both a legal and ethical manner?

A system of "trust" has developed over the decades of jurisprudence in this Country between Law Enforcement and our Judicial System. They seem to rely on each other to reinforce their “testimony” and “decisions” thereby continuing a system that enhances revenue for both. Even when oversight discovers corruption, the penalties do not equal what a “common” individual would experience in the same situation. IMHO.

IMO the "trust" that may have existed historically is drastically been reduced, not only as a result of the perceived corruption within the system, but shifting societal views where individuals are more equal.
Without totally destroying the existing system is there anything that brings balance back into the system so that an officer's testimony is no more valid than another's?
