Cop-Watch: An Analysis of the Right to Record Police Activity and Its Limits

Over the last year, the news headlines blaring that a police officer’s potentially inappropriate actions were recorded have become almost too familiar. The social climate has shifted to one where much of the historic trust that was placed in police officers has become questioned following the events in Ferguson, Missouri, and Staten Island, New York. The timing of this social climate shift has lined up perfectly with the prominence of smart-phones that are capable of recording high definition videos and sound recording. However, police have also historically cited to wiretap laws, which were intended to protect citizens from being recorded without consent, as a basis to arrest citizens for videotaping police
activity.
